Welcome to OnlyPaw. These Terms of Service ("Terms") govern your use of the OnlyPaw mobile application and website (the "Service") operated by OnlyPaw ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Service.
2. Eligibility
You must be at least 18 years old to use our Service. By using OnlyPaw, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
3. Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
4. Services Description
OnlyPaw is a platform that connects pet owners ("Customers") with pet care service providers ("Providers"). We facilitate the connection between Customers and Providers but are not ourselves a pet care provider. Services available through the platform may include:
- Dog walking
- Pet sitting (in-home or at provider's home)
- Pet grooming
- Pet boarding
- Pet daycare
- Pet training
5. Provider Terms
If you register as a Provider, you agree to:
- Complete all required verification and background check processes
- Provide services in a professional, safe, and humane manner
- Maintain accurate availability and pricing information
- Respond to booking requests in a timely manner
- Comply with all applicable local laws and regulations
- Maintain appropriate insurance coverage where required
- Treat all animals with care, kindness, and respect
6. Customer Terms
If you use OnlyPaw as a Customer, you agree to:
- Provide accurate information about your pet(s), including health conditions and behavioral issues
- Ensure your pet's vaccinations are up to date
- Provide necessary supplies (leash, food, medication) as required
- Pay for services as agreed upon booking
- Treat Providers with respect and courtesy
7. Bookings and Payments
All bookings made through OnlyPaw are agreements between Customers and Providers. OnlyPaw facilitates the booking process and payment collection. Payments are processed securely through our third-party payment processor (Stripe). By making a booking, you agree to:
- Pay the agreed-upon price for the service
- OnlyPaw may charge a service fee on transactions
- Cancellation policies as specified at the time of booking
- Refund requests will be handled on a case-by-case basis
8. Cancellation Policy
Cancellations made more than 24 hours before the scheduled service are eligible for a full refund. Cancellations made within 24 hours may be subject to a cancellation fee. No-shows will be charged the full service amount. Providers who cancel repeatedly may have their accounts suspended.
9. GPS Tracking and Location Services
Our Service includes real-time GPS tracking during walks and certain other services. By using this feature, Providers consent to having their location tracked during active service sessions. This data is shared with the Customer who booked the service and is used to ensure pet safety.
10. Reviews and Ratings
Users may leave reviews and ratings after completed services. Reviews must be honest, accurate, and based on actual experiences. We reserve the right to remove reviews that are fraudulent, abusive, or violate these Terms.
11. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Harass, abuse, or threaten other users
- Provide false or misleading information
- Circumvent the platform to avoid paying fees
- Attempt to contact users outside the platform to avoid fees
- Upload harmful, offensive, or inappropriate content
- Interfere with the proper functioning of the Service
- Engage in any form of animal abuse or neglect
12. Limitation of Liability
OnlyPaw acts as a platform connecting Customers and Providers. We are not responsible for the actions, omissions, or conduct of any user. To the maximum extent permitted by law, OnlyPaw shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
13. Indemnification
You agree to indemnify and hold harmless OnlyPaw, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
14. Intellectual Property
All content, trademarks, logos, and intellectual property displayed on the Service are owned by OnlyPaw or its licensors. You may not use, reproduce, or distribute any content without our prior written consent.
15. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OnlyPaw operates, without regard to conflict of law principles.
